MINOT – A motion to dismiss a negligent homicide charge against Scott Parizek, 33, Ruthville, was denied in North-Central District Court Thursday by Judge Todd Cresap.
Parizek’s attorney, Steven Mottinger, Fargo, told Cresap that, “This is an unusual case” and “should be dismissed at this point.” Mottinger maintained the case against his client was civil rather than criminal.
Cresap disagreed and kept Parizek’s bond at $50,000 rather than the $5,000 requested by Mottinger.
The felony C charge against Parizek, which carries with it the possibility of five years imprisonment and a $10,000 fine, began on August 8, 2022. Parizek was arrested and charged on March 20, 2023.
During Thursday’s court appearance Tyler Schiller, Ward County Sheriff’s Office, testified under oath about the reason for Parizek’s arrest. According to the investigator, Parizek brought a “Jane Doe” to the Trinity Hospital Emergency Room twice, once during the late evening of Aug 8, 2022, and again in the early morning of Aug. 9, 2022.
The first time at the ER Parizek left without the victim, later identified as Kyra Derouin, 28, Minot, being seen by hospital personnel. When Parizek returned to the ER approximately four hours later an unconscious and bleeding Derouin is admitted. She died of head injuries on Aug. 19, 2022.
According to Schiller, Parizek provided conflicting stories about how Derouin was injured, saying both that she had crashed a dirt bike near Deering and that she had fallen off the hood of his vehicle.
Tiffany Sorgen, assistant state’s attorney, told Cresap that Parizek “prevented Jane Doe from receiving care for four hours” and that the victim had “lost almost half of her blood volume.”
A pretrial conference on the case is scheduled for July 5 at 8:30 a.m.
