Driver Jailed, Bond Hearing Set 

WATFORD CITY – A resident of this community, Julian Montoya, 19, has been arrested for negligent homicide because of a car/bicycle collision April 8. The incident occurred shortly before 7 p.m. in the parking lot of the Madison Heights Apartments. 

According to an affidavit filed in Northwest District court, a 6-year-old boy, later identified as Ian Garcia, was in the area of the parking garages when struck by a Toyota driven by Montoya. A witness told a responding Highway Patrol officer that the Toyota was going fast and didn’t try to stop even after the child was struck. 

Investigation by the HP, says the affidavit, “supports the witness statement that the vehicle was going fast around the corner” and that skip skid marks were “consistent with rear tires spinning due to rapid acceleration.” 

The posted speed limit at Madison Heights is 10 mph. 

The bicycle remained lodged under the Toyota. The child was deceased at the scene. Montoya is being held at the McKenzie County Correctional Center in Watford City. He has a bond hearing set for 11:00 a.m. Wednesday.
