House Bill 1458, introduced by a group of state representatives and Senator Magrum, aims to prohibit the intentional exposure of individuals to engineered pathogens without their explicit written consent.
The bill defines a "self-spreading virus or bacteria" as any engineered virus, bacteria, or similar substance capable of transmitting from person to person. Under the proposed legislation, any individual or entity involved in the creation or release of such biological agents would be required to obtain written consent from every person who could potentially be exposed.
Failure to comply with the law could result in significant penalties. The bill grants individuals the right to seek legal action against violators, allowing them to claim actual monetary damages or a minimum of $5,000 per violation, whichever is greater.
